License
This license agreement is between the Guest, the Licensee of rental property and StayRoman, Inc. (“StayRoman”), the Licensor authorized by the owner (“Owner”) of said rental property (“Property”), as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

In consideration of the monies paid and promises contained herein, the Owner does hereby grant to the Guest, the license to use those premises during the period as indicated in the Reservation.
Guest acknowledges that he/she is occupying the premises only as a licensee of the Owner, and that this agreement does not create a landlord-tenant relationship, or any other interest in the Owner’s property.
Owner and/or StayRoman reserve the right to revoke the license agreement “at will”.
Owner and/or StayRoman retain absolute control over the premises.
Owner and/or StayRoman agree to supply the licensee of all the essential services required for the licensee’s permitted use of the premises.
The license described herein is non-transferrable.
Rental Rules
1. Smoking and vaping are NOT allowed inside.
2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
3. All of the units are privately owned; the owners and/or StayRoman are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners and/or StayRoman are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
4. Keep the property and all furnishings in good order
5. Please respect the homeowner and neighbors by refraining from making excessive noise, playing loud music, or having an excessive number of people at the house at any time.
a. Events and parties are not allowed. This home is located in residential neighborhood. Loud noise, especially outside, is always discouraged, and strictly prohibited after 9pm. If neighbors can hear you or your music from the street in front of the property, you are in violation of the city noise ordinance, and therefore, our rental rules. If you are coming/going for a night out on the town, please be mindful of car door noise, etc when you return home. We want you to have a great visit, but it is extremely important that guests be respectful of our property’s neighborhood and the people that live here. If this rule is violated, and the neighbors complain and/or city cites the property a violation, your reservation will be terminated immediately, without refund, and may be subject to liquid damages.
b. Illegal substances and/or activities are strictly prohibited.
c. Owner or Owner’s Representative reserves the right to require guests to depart the premises, without refund, if these rules is ignored.
6. Only use appliances for their intended uses
7. PETS are NOT permitted.
8. PARKING – Driveway parking is generally available. Street parking is generally allowed. We’re happy to answer questions about parking at your specific property.
9. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units.
a. All dishes used should be run through the dishwasher or hand washed prior to departure.
b. Please place any used towels in the bathtub prior to departure. Sheets can remain on the beds. Thanks!
10. Check out Policies. Guest should be checked out of home by 11am of last day, unless another time is specifically agreed upon. After making sure the house is securely closed up, please place all keys in lockbox and relock. Missing keys will result in a rekey fee being deducted from the security deposit.
a. Penalty for an unapproved late check out is $50 per hour
b. Deposit will be refunded within 30 business days.
- Landlord shall have the right to retain the Rental Deposit at the Landlord’s discretion.
Important Occupancy and Gathering Rules, as it pertains to homes.
StayRoman imposes strict rules regarding occupancy and gatherings. These rules will be uniformly enforced at all Short Term Rentals within the company, and we are obligated to inform you of these rules and enforce them.
Maximum Occupancy: This is VERY important! Please read closely. The maximum number of guests allowed for a property is stated on the property’s listing page. StayRoman strictly prohibits any groups with more than the listed authorized number of guests for our Short Term Rental properties. If your group exceeds occupancy authorization, and the above maximum occupancy allows more than 6, you must be able to prove that at least a portion of the group is related. The overall size of your group cannot exceed the maximum adult occupancy stated on the property’s listing. Undeclared guests are not allowed. These are extremely strict rules that StayRoman is requiring you and your guests to abide by, and they MUST be honored. If this rule is violated, and the city cites the property a violation, your reservation will be terminated immediately, without refund, and you and your guests may be subject to liquid damages.
Gatherings: StayRoman prohibits groups of more than 6 to gather on the outside portion of the property at any one time, and additionally prohibits any outside gatherings after 10pm. This rule, limiting gatherings of 6, applies even if the maximum occupancy of the house exceeds 6. These are extremely strict rules that cities are requiring you and your guests to abide by, and they MUST be honored. If this rule is violated, and the city cites the property a violation, your reservation will be terminated immediately, without refund, and you and your guests may be subject to liquid damages.
Cancellation Policy
If Guest wishes to cancel his/her reservation:

ALL SALES ARE FINAL AND CANCELLATIONS WILL BE PENALIZED AS SUCH
- Guests can change their travel dates in the event of an emergency
- Guests can also receive travel credit towards future travel dates in the event that guests need to cancel due to emergency or due to any necessary changes before/during/after their stay
Emergency’s: Death of spouse/parent/child, positive COVID test within 5 days of travel, or travel ban to destination from origin.
Owner/Mgmt reserves right to cancel reservation in the rare event that circumstances are deemed necessary by management. If cancellation is necessary guest will receive a full refund in the form of travel credit. This does not apply to guests cancellations.
CHOICE OF LAW AND VENUE. Any claims arising out of this Agreement, contract, tort, or otherwise,
will be governed by the laws of the State of Delaware, without regard to its conflicts of law principles. Should litigation
beyond arbitration arise, each party hereby irrevocably consents to the jurisdiction and venue of the state and federal courts
located in Lewes, DE.
ATTORNEY’S FEES. The losing party in any controversy in connection with this Agreement shall
reimburse the prevailing party for all reasonable attorney’s fees and costs incurred by the prevailing party in its successful
enforcement of the terms of this Agreement.
ENTIRE AGREEMENT. This Agreement contains the entire understanding between the parties with
respect to the subject matter of this Agreement, and supersedes any and all prior negotiations, representations and
agreements, whether written or oral, between the parties with respect thereto. Each party acknowledges that no
representations, inducements, promises or agreements, orally or otherwise have been made by any party, except as expressly
stated herein.
FURTHER ASSURANCES. Each party shall cooperate with the other and execute such instruments or
documents and take such other actions as may reasonably be requested from time to time in order to carry out, evidence or
confirm their rights or obligations or as may be reasonably necessary or helpful to give effect to this Agreement.
SEVERABILITY. If any term of this Agreement is found to be invalid by a court or other tribunal of
competent jurisdiction, the remainder of the Agreement shall continue to be valid and enforceable.
AMENDMENT. No amendment, modification, or addition to this Agreement shall be valid or binding unless
expressed in writing and signed by both Landlord and Tenant.
NEXT BUSINESS DAY. Any date specified in this Agreement which falls on a Saturday, Sunday or legal
holiday shall be automatically extended until the first regular business day after such date.
COUNTERPARTS. This Agreement may be executed in one or more counterparts, each of which shall be
deemed an original and all of which, taken together, shall be construed as a single instrument. Signatures on counterparts
of this Agreement transmitted by facsimile or e-mail shall be deemed effective for all purposes.
NOTICES. Any notice, demand or communication which either party may desire or be required to give to
the other party shall be in writing and shall be deemed sufficiently given or rendered if delivered via electronic mail and
followed up with overnight mail delivery to 16192 Coastal Hwy, Lewes, DE 19958.
